Wendy Lumish is Practice Group Leader for Bowman and Brooke’s Appellate and Advance Motions practice group and is the managing partner in the Miami office. Her area of practice includes legal issues and appeals in defense of product liability, catastrophic personal injury and medical malpractice cases. In particular, since the mid 1980’s, Wendy has extensive experience working on legal issues of national significance for the products industry including the test of design defect, warnings, crashworthiness, the use and scope of expert testimony, causation, damages including punitive damages, and personal jurisdiction. From the beginning of her career, Wendy’s practice has included extensive participation at the trial court level to address legal issues and preserve error for appeal. This includes evidentiary issues at the core of product liability trials like admissibility of other accidents, testing and statistics. Wendy assists with general trial strategy, preparation of dispositive motions, motions in limine, and expert motions. One of her most important roles has been with jury instructions and verdict forms because they impact not only the way the case is tried, but are an issue that is often the subject of appeals. Wendy routinely attends trials to argue these issues. She also handles the post-trial and appellate briefing, as well as appellate oral arguments. As an active member of the Product Liability Advisory Council for more than 20 years, Wendy has written amicus briefs and has been a frequent speaker at meetings on topics related to jury instructions, preservation of error and damages. She also serves on the Case Selection Committee which determines the amicus briefs to be written for PLAC. Wendy is also active in the Lawyers for Civil Justice where she serves as the chair of its amicus program. For nine years, she served on the Florida Standard Jury Instruction Committee where she was involved in revisions to the product liability jury instructions. Through all of these experiences, Wendy has focused on how to change the law to better reflect and fair and balanced approach to legal issues.


Her experience in this realm has earned her national recognition from a multitude of legal publications including Chambers USA, Benchmark Litigation and Super Lawyers Magazine. She is board certified in Appellate Practice by The Florida Bar and a member of the American Academy of Appellate Lawyers. She is admitted in Florida and Minnesota as well as her original home state of New Jersey.
